Yes, if you don't build a frame to raise the seats so the bottom seat latches lock as necessary. These latch brackets are sold on ebay separately so maybe some folks are hammering dents into their floors where the latches need the recess.

Yes, again, a recess is needed in the floor, unless you raise the seat onto a custom frame.
