Send him an email asking for you "cut" from the sales... I mean he is claiming it is from his own original photograph.

Re: My old truck on T-shirts ...

Actually went through a similar situation with a siding material company that I purchased the products from. They wanted to put pictures of the house in their new brochure. I consulted with a professional photographer and he explained that anyone can take a picture as long as the topic of the picture is not being used because of the artistic value of the subject matter. Once the artistic value has been determined, the subject artist has the right to profits of the photo or to sign a waiver allowing the photographer to profit by it. When I asked for some compensation for my client who paid me to design and install the siding panels, the supplier tried to convince us that this would be a compliment to what we had done and that they could do anything they wanted. After checking with their lawyers they dropped it all together.

It's a compliment that he's making money selling shirts with your truck on it....but wrong because he's lying about the picture....

Re: My old truck on T-shirts ...

I would email him nicely. Just say thanks for the compliment of using my truck. That however was MY picture and unless I signed a release for the copyrights, you are not the owner of that photo. Please send all profits to me or blah blah..

Thing is, if you did sign anything for him to do the work.. you may have signed the right for him to use the picture as he sees fit.

I know this was not the intent of your thread, but copyright infringement irks me badly.

I think if you just let him know he shouldn't do that kind of stuff. You don't have to sue him at all.

"Send" is to mean that Chief should "Send" a copy.

"Sent" would mean that he has already "Sent" a copy.
